These Terms and Conditions (“Terms”, “Terms and Conditions”) govern your relationship with https://virtucamera.com website and VirtuCamera mobile application (the “Service”) operated by Pablo Javier Garcia Gonzalez (“us”, “we”, or “our”).
Please read these Terms and Conditions carefully before using our website and VirtuCamera mobile application (the “Service”).
Also read our Privacy Policy and Cookie Declaration, as they apply to your use of the Service in addition to any applicable terms and conditions and privacy policies (including any EULAs) of the relevant app store provider(s) from whom you downloaded the Service (the “App Store Provider”) which also apply.
You acknowledge that the App Store Provider is not a party to the Terms and that the Terms are concluded between you and us only.
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
Subscriptions
Some parts of the Service are billed on a subscription basis (“Subscription(s)”). You will be billed in advance for a subscription period (“Period”). Periods are set for a duration of a month.
At the end of a Period, your Subscription will not automatically renew and you won’t be allowed to use the parts of the Service subject to Subscription unless you subscribe again for a new Period.
You acknowledge and agree that all billing and transaction processes are handled by the App Store Provider from whose platform you downloaded the Service and are governed by the App Store Provider’s terms and conditions/EULA. If you have any payment related issues with Subscriptions then you need to contact the App Store Provider directly.
Refunds
Except when required by law or authorised by the App Store Provider’s Refund Policy, paid Subscription fees are non-refundable. If you wish to request a refund, you may do so by contacting the App Store Provider directly.
Free Trial
Pablo Javier Garcia Gonzalez may, at its sole discretion, offer a free trial Subscription for a limited period of time (“Free Trial”).
At any time and without notice, Pablo Javier Garcia Gonzalez reserves the right to (i) modify the terms and conditions of the Free Trial offer, or (ii) cancel such Free Trial offer.
Fee Changes
Pablo Javier Garcia Gonzalez, in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions.
A Subscription for a new Period after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.
Minimum system requirements
Smooth running of the Service depends on the hardware and software used by the user. In order to access and use the Service, as a minimum, you require the following hardware and system specifications, including but not limited to:
- An Apple® device with iOS 12.1 (or greater) and compatible with ARKit
- A computer powerful enough to play your 3D scenes
- A recent version of Windows®, MacOS® or Linux® operating system.
- A stable WiFi connection
- A working copy of Blender® 2.83 (or greater) or Autodesk® Maya® 2017 software (or greater) installed
- The last version of the plug-in provided in our webpage properly installed
Intellectual property
Total or partial reproduction of text, images, and other content on the Service without our consent is prohibited.
Warranty Disclaimer and Limitation of Liability
The Service is provided on an “as is” and “as available” basis, without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose and noninfringement. in no event shall we be liable for any claim, damages or other liability, whether in an action of contract, tort or otherwise, arising from, out of or in connection with the Service or the use or other dealings in the Service.

These Terms shall be governed and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.
